On April 11th, Lawmakers in Alabama advanced a legislation that define who is considered to be a man or a woman under state law based on your reproductive system and not your gender identity. More than a dozen republican states this year have proposed bills that would change the definition of sex. Supporters of the bill say that it is needed to provide clarity to the citizens while opposers are saying it targets the rights of transgender, non-binary and intersex people.
The Alabama House of Representatives voted 77-24 for the legislation that declares “there are only two sexes” and writes definitions for male, female, boy, girl, mother and father into state law. Republican state representative and bill sponsor, Susan Dubois stated, ” In Alabama we know what a woman is, this law will provide clarity for our courts and is an important step in increasing transparency in our state while protecting women’s rights, women’s spaces and preventing sex discrimination”. Opponents however are saying that this new bill is part of ongoing attacks on the rights of transgender people to live their everyday lives. Democratic state rep responded to the bill and said, ” I don’t believe it does anything to protect women rights, I believe what its attempting to do is silence non-binary and transgender Alabamians”
The bill states that “every individual is either male or female” and that “sex does not include ‘gender identity’ or any other terms intended to convey an individual’s subjective sense of self.” The legislation defines sex based on reproductive anatomy. In the bill it defines a woman as a person, “who has, had, will have, or would have, but for a developmental anomaly, genetic anomaly, or accident, the reproductive system that at some point produces ova.” And a man as a person who, “who has, had, will have, or would have, but for a developmental anomaly, genetic anomaly, or accident, the reproductive system that at some point produces sperm.”
Sources are reporting that it is unclear how the new wave of bills will impact people who are intersexual however I think it is very clear that it will do nothing but make their lives more difficult. When a child is born with both male and female reproductive traits the parents will have to choose the sexual identity of the child making it harder for them to fully identify correctly maybe ever in their life.

This bill is part of of a new wave of legislations that are seeking to regulate bathrooms, school sport teams and prohibit gender affirming medical care. If these bills are it will only increase the hardships that transgender, non-binary and intersexual people are facing every day.
